Legally you must get the permission of the copyright holder to publicly perform or use more than two measures of their music. It does not matter whether or not it is for profit. Consequences can range from nothing (usually), to hundreds of thousands of dollars in fines (it happened to a University of Georgia student) and/or prison time (I've never heard of it happening, but it's part of the statute), depending on whether the artist's lawyers want to make an example or not. How lucky do you feel?

Check out remix comps.com or indaba music
That's the best way to remix songs and not have to worry about the legal aspect as the artist and label are giving you the permission but always make sure to read the T&C's.
Alternatively there are stems on itunes that you can purchase, not for every song out there but there are some popular songs that you can buy the stems for.
I prefer remix comps as the stems are free and there's a chance you might win some prizes but competition is fierce
If you do decide to remix a copyrighted song without the artists permission first then I'd say just send them the demo first and ask for permission. A lot of people do it without the artists or labels consent and in most cases the label will just try to get the track blocked. I have seen however some artists that have heard a bootleg of their song and then promoted it because they like the remix. There's never really any way of knowing what will happen just try to avoid pissing off the major labels lol

You know what they say--if it looks too good to be true, it probably is. Be sure to check it out carefully. Let us know how it goes.
